How do I start an eviction enquiry?

What information will I need to provide?

As the matter progresses, information such as the tenancy agreement, the rent record and any notices already served is usually relevant. Please do not send sensitive documents with your initial enquiry.

How long does the eviction process take?

This varies and cannot be predicted in advance. The route that applies, the stage a matter reaches, how the tenant responds and county court availability all affect timescales. We will explain what each stage typically involves, but we do not promise particular dates or outcomes.

What happens if my tenant is in rent arrears?

Rent arrears are one of the most common reasons landlords contact us. The relevant considerations usually include the tenancy terms, the payment history and the level of arrears. Once we understand the position, we can explain the options that may be open to you.

What if the tenant refuses to leave?

If a tenant does not leave after a notice period ends, a landlord cannot remove them without following the correct legal process. In that situation a matter may need to progress through the appropriate possession procedure, and we can explain what that involves.

Which possession route applies to my situation?

That depends on the type of tenancy, how it was set up, the current circumstances and the legislation in force at the time. We do not assume a particular route applies before the details have been reviewed, and we cannot confirm eligibility from general information alone.

We aim to respond to enquiries within 24–48 hours. Our business hours are Monday – Friday, 9:00 AM – 5:00 PM UK time, and enquiries received outside those hours are reviewed on the next working day.

Is Section 21 being abolished?

Accepted Answer

The Renters' Rights Act removes the Section 21 'no-fault' possession route for assured shorthold tenancies. Once the relevant provisions are in force, possession must be sought on a stated ground rather than without reason. The rules that apply to a notice are those in force at the time it is served, so we review the position before advising on a route.

What replaces fixed-term assured shorthold tenancies?

Under the reforms, fixed-term assured shorthold tenancies are replaced by periodic (rolling) tenancies. Existing tenancies are converted rather than needing to be re-signed, but it does mean your tenancy documentation and rent records become more important in any possession matter.

Can I still recover possession if I want to sell or move in?

The reforms revise the grounds available under Section 8, including grounds relating to a landlord selling or moving into the property, each with its own conditions and notice period. Whether a ground is available in your case depends on your circumstances and the legislation in force, which is why we review the details first.

Transitional provisions can affect matters where a notice was served, or proceedings started, before the relevant reforms commenced. Tell us what has been served and when, and we will explain how the position is usually treated and what your options may be.

What should I prepare before making an enquiry?

A clear rent record, the tenancy agreement, deposit protection details, the gas safety record, EPC and How to Rent guide, plus any notices already served and a note of what has been raised with the tenant. You do not need to send documents with your initial enquiry. Just tell us what exists.

Do you handle properties outside England?

Our services are for landlords and property owners with residential property in England. Tenancy and possession law in Wales, Scotland and Northern Ireland is different and outside the scope of what we support.
